GENERAL TERMS AND CONDITIONS OF THE ONLINE SHOP

1. SCOPE OF APPLICATION
This online shop is operated by Trek Bicycle Corporation UK, (hereinafter “Trek”, “we”, “our”), Victory House, Ortensia Drive, Milton Keynes, MK17 8LX, United Kingdom.
All orders placed via the online shop and contracts concluded with TREK are subject to these General Terms and Conditions (GTC).

2. CONCLUSION OF CONTRACT
By placing products in a shopping cart and clicking the “Pay” button, the customer submits an offer to TREK to conclude a purchase contract. A contract is entered into as soon as TREK confirms acceptance of the offer in writing to the customer (email regarding order or dispatch confirmation) or dispatches the products. After the offer is accepted, the customer is bound by his/her order and can no longer change it unilaterally.
Products and prices displayed on a website are not requests for conclusion of a contract, but rather invitations to the customer to order products.
TREK reserves the right to refuse to fulfil, in whole or in part, the purchase contracts concluded without giving any reason. In such cases, the customer will be refunded any payment already made. Any additional claims from the customer vis-à-vis TREK are excluded.
TREK only accepts orders through the online shop.

3. PRICES AND SHIPPING COSTS
Prices are quoted in Pound (GBP) including VAT. The price specified at the time when the binding order is placed is decisive. The shipping costs are invoiced to the customer in addition to the purchase price of the ordered products.
The standard shipping costs within the UK amount to GBP 3.99 per order of parts and accessories for home deliveries. Collect In Store orders are shipped free of charge to your local Trek retailer. For a parts and accessories order value above GBP 50.00, shipping is free of charge within the UK.
Delivery on bikes to your local Trek retailer will be free of charge. Premium home delivery of bikes valued GBP 1,000.00 and above is free of charge within the UK. Premium home delivery of bikes valued less than GBP 1,000.00 will be GBP 50.00 within the UK.
No shipping out of the country. Shipping to UK mainland only. No shipping to Northern Ireland, the Channel Islands of the Isle of Man.

4. HOME DELIVERY

Orders will be sent to the home address provided by the customer within UK mainland. No PO boxes allowed. All deliveries will require a signature, and a valid proof of ID will need to be shown.

Standard home delivery is handled by a delivery service specified by TREK (generally Royal Mail or one of our delivery partners). Home deliveries do not include services such as unpacking, assembling or adjusting the products. The customer must ensure that the specified home address is covered by delivery service specified by TREK. 

Premium home delivery is handled by a delivery partner service specified by TREK or delivered by our Trek Bicycle store team directly. Premium home deliveries include unpacking and minor adjustments the products. 


5. PICKUP DELIVERIES

Orders can be delivered to a local Trek retailer for pickup by the customer from there. When placing an order for pickup, the customer must choose the local Trek retailer to pickup the order from. Once an order has arrived at the local Trek retailer, the customer is informed that the order is ready for pickup. The local Trek retailer will only hand over an order upon presentation of the pickup notification and an official ID. The customer must confirm receipt of the order in writing for the local Trek retailer’s records. 

When collecting a delivery of a bicycle, the customer is entitled to have the aforementioned ordered products assembled and adjusted by the local Trek retailer.

Once the customer has been informed that ordered products are available for pickup, the customer must pick up the delivery within one month. If not collected within this period, the customer will be deemed to have waived the right to contract performance by TREK.

6. DELIVERY TIMES
TREK confirms receipt of an order and the availability of the ordered products to the customer by email. In principle, the customer receives the products ordered within 14 working days of receipt of the aforementioned confirmation email.

7. RIGHT OF WITHDRAWAL
The customer has the right to withdraw from contracts concluded with TREK. The right of withdrawal is duly exercised if the products are handed over by the customer to a parcel delivery service for shipment to TREK or returned to a TREK store within 30 days of receipt of the order.
For any products returned, the customer will be refunded the purchase price paid. A purchase price refund requires that the product is received by TREK fully intact, unused and undamaged, with all labels and manuals.
For any aftermarket return shipments, the customer must bear the return costs him/herself.
Bicycles must either be returned by the customer themselves to a TREK store, or the customer must contact TREK to arrange authorised collection. Trek authorised collections will be arranged by a TREK representative from the original delivery address only, and the customer will be charged GBP 50.00 fee for processing the return and collection. This collection and processing fee will be deducted from the refund amount of the purchase price paid. The refund to the customer is handled by TREK or by a service provider commissioned by TREK.

The customer can also assert his/her right of withdrawal vis-à-vis TREK by way of a withdrawal notice. To do this, the customer must either submit a withdrawal notice to TREK within 30 days of receipt of the order, clearly stating his/her decision to withdraw from the purchase contract, or may send a notification to the following address:

If the customer first submits a withdrawal notice, the products for which the withdrawal notice is submitted must be returned to TREK. The products must then be shipped within 14 days of submission of the withdrawal notice to TREK.

8. DEFECTS IN THE PURCHASE ITEM, WARRANTY AND MANUFACTURER GUARANTEE
If, in the event of a home delivery, damage to the packaging is visible, the customer must refuse acceptance of the delivery from the parcel delivery service.
After acceptance of a delivery, the customer must immediately check the product(s) received. Any defects must be reported immediately to TREK for the purpose of asserting warranty claims upon discovery of said defects. In any event, the warranty rights of the customer expire two years after receipt of the ordered products. TREK may satisfy the warranty claims of the customer by a replacement delivery, a free repair, or a complete or partial refund of the purchase price.

9. PAYMENT METHODS
In principle, the following methods of payment can be selected: credit card (Visa and MasterCard) and PayPal. TREK is always free to decide which payment method(s) are offered to the customer and this list of payment methods may be added to or amended at any time. The customer's account is debited when the order is shipped.

10. EX-DEMO, EX-RENTAL, EX-DISPLAY AND SECOND-HAND BIKES (“EX-DEMO bikes”)
By purchasing an EX-DEMO, EX-RENTAL, EX-DISPLAY or a SECOND-HAND BIKE (“EX-DEMO bikes”), the purchaser accepts the described condition of the bike. EX-DEMO bikes have been ridden and have some defects and wear. The condition of EX-DEMO bikes is designated by the grade of the bike. 

EX-DEMO bikes are excluded from the standard Trek Bicycle Corporation Limited Warranty Policy. For more information, see: Warranty Policy


11. RETENTION OF TITLE
TREK reserves the right to ownership of the purchase item until the purchase price has been paid in full. Upon payment of the purchase price, title will be transferred to the customer completely and without reservation.
In the event of resale of the goods before payment of the purchase price, the customer is obliged to inform the future buyer about the retention of title.

13. APPLICABLE LAW AND JURISDICTION
All purchase contracts between the customer and TREK are subject to the laws of the UK, with the exclusion of all rules of international private law which refer to foreign law. The Vienna Convention on Sales of Goods is not applicable.
